IMPORTANT SERVICE PLAN DISCLOSURE
The initial price shown and accepted at checkout is based on the selected service and current promotion, if any, and becomes the customer's standard recurring monthly rate unless later changed after advance email notice. Residential service is a cancel-anytime recurring pest-management plan with the first recurring charge generally 30 days after booking, routine preventative service approximately every 80 to 100 days, and qualifying covered callbacks at no additional service charge, limited to one callback visit within any seven-day period. Severe infestations and specialty services may require separately priced treatment with customer approval.
1. Acceptance of Terms
These Terms & Conditions ("Terms") govern access to and use of gethonex.com, Honex online booking, estimates, appointments, payment processing, recurring pest-management plans, customer communications, and pest-control services provided by Honex A+ Pest Solutions LLC ("Honex," "we," "us," or "our").
By accessing the website, submitting a service request, booking an appointment, checking an acceptance box, electronically signing, submitting payment, authorizing recurring billing, accepting a proposal, or allowing Honex to perform service, you agree to these Terms and any service-specific terms presented to you. If you do not agree, do not complete the applicable transaction.
2. About Honex and Scope of Services
Honex provides pest-management and related services only where properly licensed and authorized. All services are subject to federal, state, and local law, licensing requirements, pesticide labels, safety requirements, and the professional judgment of authorized personnel.
Website descriptions are general. Availability, treatment methods, pricing, and service categories may vary by property, pest, location, and licensing status.
3. Relationship Between These Terms and Service-Specific Agreements
These Terms are the general public-facing terms for Honex. Certain services may also require a proposal, service agreement, work order, treatment authorization, recurring-service agreement, termite or wood-destroying-organism agreement, warranty, or other written document.
If a service-specific written agreement conflicts with these Terms, the service-specific agreement controls for that service. These Terms do not replace any document or disclosure required by law.
4. Initial Service Pricing Is Variable
Prices displayed on the Honex website or during online booking are based on the service selected and the information available at the time of booking. Honex may run promotions, discounts, or introductory offers, and the initial price shown may vary. The price actually accepted and paid by the customer at checkout becomes that customer's standard recurring monthly service rate unless Honex later changes the recurring rate after providing advance notice by email before the revised rate is charged.
The actual initial-service price may increase or decrease based on factors such as pest type, severity, property size or type, requested service, treatment scope, number of areas requiring service, accessibility, specialty requirements, property conditions, and other circumstances reasonably affecting the work.
5. Price Changes and Customer Approval
If Honex determines that the applicable price should materially increase or decrease based on the actual service needed, Honex will inform the customer of the revised price before performing service at the revised price or charging the customer the revised amount.
Honex will not knowingly perform additional paid work and then surprise the customer with an undisclosed additional charge. A material price increase or additional paid service requires customer authorization before the charge is incurred.
If the appropriate price is lower than originally anticipated, Honex may reduce or adjust the customer charge accordingly.
6. The Honex Standard Service / Four Corner Treatment
The Honex Standard Service is our standard general household pest treatment and may be referred to as the "Four Corner Treatment." The name describes Honex's standard treatment protocol and does not mean treatment is literally limited to four physical corners of the property.
Depending on the property, target pest, conditions observed, accessibility, product labeling, and technician judgment, treatment may include appropriate interior and/or exterior areas, perimeter areas, cracks and crevices, baseboards, plumbing or utility penetrations, entry points, kitchens, bathrooms, garages, accessible harborage areas, and other locations reasonably included in the selected service.
Honex does not promise that every possible listed area will be treated during every appointment. Treatment is tailored to conditions found.
7. Recurring Monthly Pest-Management Plan
Unless otherwise specifically stated during booking, Honex residential pest-control service is structured as a recurring pest-management program rather than a pay-per-visit arrangement.
The customer pays the initial service amount when booking online and selects an available service date. Unless otherwise disclosed at checkout, the first recurring monthly charge occurs 30 days after the initial purchase and recurring charges continue approximately every 30 days thereafter until canceled. The recurring rate is the price accepted and paid at checkout unless later changed after advance email notice. The monthly charge is payment for continuous pest-management coverage and is not limited to months in which a routine treatment visit occurs.
8. Routine Service Approximately Every 90 Days
Routine preventative treatment is generally performed approximately every 90 days after the initial service. For routing and scheduling flexibility, routine service may normally occur approximately 80 to 100 days after the prior routine visit. The exact date may vary because of routing, customer availability, weather, holidays, staffing, treatment requirements, access, or other operational considerations.
A routine visit occurring slightly before or after the 90-day interval does not change the monthly billing cycle or convert the plan into per-visit billing.
9. Complimentary Callback Treatments Between Scheduled Visits
If a covered pest problem returns or persists before the next routine service, the customer may contact Honex for a callback. For qualifying pest activity covered by the customer's active and current plan, Honex will provide an appropriate callback treatment at no additional service charge, subject to a limit of one callback visit within any rolling seven-day period.
The customer is not charged another standard visit fee merely because covered pest activity requires Honex to return before the next approximately 90-day preventative visit. The customer's normal monthly recurring billing continues.
10. Scope of Complimentary Callbacks
A complimentary callback is intended to address continuing or recurring activity involving a pest reasonably covered by the customer's current plan. It may include inspection of reported activity, evaluation of treated areas, additional treatment where appropriate, adjustment of bait or treatment placement, treatment of newly identified harborage or entry areas within scope, and reasonable recommendations.
The precise callback treatment is determined by the technician based on observed conditions, safety, law, product labeling, and professional judgment.
11. Callback Exclusions
Complimentary callbacks apply only to pests and services covered by the customer's active plan. They do not include termites or other wood-destroying organisms, fumigation, bed bugs, fleas, ticks, bees, wildlife services, structural exclusion, remediation, major repair, treatment at another property, or other specialty work outside the plan. Rodent and mosquito services are covered only to the limited standard scope described in these Terms.
If the reported condition requires service outside the existing plan, Honex will explain the recommended service and price before the customer authorizes additional paid work.
12. Severe, Established, or Complex Infestations
Standard service and routine recurring coverage are intended for conditions that can reasonably be managed through Honex's standard pest-management procedures. Severe, widespread, established, resistant, unusual, or otherwise complex infestations may require additional or specialized treatment.
Examples may include intensive treatment protocols, increased visit frequency, specialty products or equipment, extensive preparation, trapping, exclusion, sanitation, fumigation, structural access, or pest-specific programs.
If additional paid treatment is recommended, Honex will explain the condition, recommended treatment, and applicable price before performing or charging for it. The customer may accept or decline.
13. If the Customer Declines Additional Treatment
If the customer declines a recommended additional or specialty service, Honex may still perform the service already purchased if the technician determines that doing so is appropriate, safe, lawful, and reasonably beneficial.
The customer understands that standard treatment alone may not adequately control a severe or complex infestation. Honex is not responsible for inadequate results caused by refusal of reasonably recommended treatment outside the purchased scope.
14. When Honex May Decline or Modify Treatment
Honex may decline, modify, postpone, or discontinue treatment if the technician reasonably determines that the requested service would be ineffective, unsafe, unlawful, inconsistent with pesticide labeling, outside the applicable service scope, outside an authorized licensing category, or inappropriate because required preparation or access is lacking.
Honex will not intentionally perform an unlawful or label-inconsistent application merely because a customer requests it.
15. Refund if an Initial Purchased Service Cannot Be Performed
If Honex determines before providing an initial purchased service that the service cannot appropriately be performed, Honex will not retain payment for an entirely unperformed service, except for any separate fee or service expressly disclosed and authorized.
This does not create a right to a refund merely because pests remain visible after service, additional treatment is recommended, pests later return, or the customer expected immediate elimination.
16. No Instant or Permanent Elimination Guarantee
Pest control is a process. Customers may temporarily observe continued pest activity, increased visible activity, dying pests, pests leaving harborages, or emergence from eggs or inaccessible nesting areas following treatment. These circumstances do not necessarily indicate treatment failure.
Unless Honex expressly provides a written service-specific guarantee, no single treatment is guaranteed to permanently eliminate every pest or prevent all future pest activity.
17. Retreatment / Service Guarantees
Any retreatment or service guarantee applies only when expressly stated in the applicable service page, checkout disclosure, booking confirmation, invoice, proposal, or written service agreement.
While an account is active and current, qualifying callback treatments for covered pests are included at no additional service charge, subject to the one-callback-per-seven-day limitation and the other conditions in these Terms. This callback benefit is a service commitment, not a money-back guarantee and not a guarantee of permanent pest elimination.
18. Conditions Affecting Guarantee Eligibility
Treatment effectiveness and any retreatment guarantee may be affected by failure to follow preparation or post-treatment instructions, failure to provide access, sanitation issues, standing water, leaks, moisture, food sources, untreated neighboring units, structural defects, open entry points, customer removal of treatment materials, conflicting pesticide applications, reintroduction of pests, or other conditions outside Honex's reasonable control.
Honex will not unreasonably deny a legitimate qualifying callback or retreatment request.
19. Services Generally Outside the Standard Plan
The standard recurring plan generally covers routine treatment for ants, cockroaches, spiders, silverfish, house flies and other common readily treatable nuisance flies, ordinary accessible wasp activity, standard mosquito treatment, and limited standard rodent treatment as described below. The plan does not include termites/WDO treatment, fumigation, bed bugs, fleas, ticks, bees, wildlife removal, structural exclusion, major sealing or repair, contaminated-material removal, attic remediation, mold or moisture remediation, construction, plumbing or electrical repair, lawn/ornamental treatment, or other specialty services identified by Honex. Severe or unusual conditions involving an otherwise covered pest may require separately priced treatment with customer approval.
20. Termites and Other Wood-Destroying Organisms
Termite and other wood-destroying-organism services are not included in the standard recurring plan unless expressly contracted. Such work may require a separate inspection, proposal, written agreement, warranty disclosures, treatment specifications, and other documentation required by Florida law.
Honex does not provide whole-structure tent fumigation. When appropriate and legally permitted, Honex may offer localized or spot termite treatment under a separate inspection, price, authorization, and termite/WDO agreement. Spot treatment is not represented as appropriate for every termite condition. Any separate termite/WDO agreement controls its warranties, retreatment obligations, repair obligations, exclusions, renewals, and other service-specific terms.
21. Rodents and Wildlife
Standard rodent coverage may include placement and reasonable servicing of up to three rodent traps in accessible locations selected by the technician when appropriate. Trap type, placement, relocation, baiting, and monitoring are determined by Honex. Standard rodent coverage does not include unlimited traps, structural exclusion, roof or attic sealing, rodent-proofing, insulation removal, sanitation or contamination remediation, carcass removal, opening walls, construction, repairs, wildlife removal, or a large-scale trapping program. Severe rodent infestations or needs beyond the standard three-trap scope may be separately priced after customer approval.
22. Mosquitoes and Outdoor Pressure
Standard mosquito treatment is included in the recurring plan and may include treatment of appropriate accessible exterior areas using products and application methods selected by Honex in accordance with product labeling and site conditions. Mosquito pressure is influenced by rainfall, standing water, neighboring properties, drainage, vegetation, weather, canals, and breeding sites outside Honex's control. No mosquito treatment guarantees a mosquito-free property. Severe or unusual mosquito conditions requiring services beyond Honex's standard treatment may be separately quoted with customer approval.
23. Bed Bugs, Fleas, Ticks, and Specialty Pests
Honex does not provide bed bug, flea, tick, or bee treatment under the standard plan. Bees are excluded from service and may be referred to an appropriate bee-removal provider. Ordinary accessible wasp activity is covered under the standard plan, but large, unusually dangerous, elevated, structurally concealed, or difficult-access wasp infestations may require separate pricing or may be declined. Other specialty pests may require separate pricing and authorization.
24. Technician Professional Judgment
Within the authorized service scope, the customer authorizes Honex personnel to use professional judgment to determine appropriate treatment areas, products, application methods, bait, dust, liquid, traps, monitoring, exclusion recommendations, whether an area should not be treated, whether re-entry restrictions apply, and whether treatment should be postponed or additional service recommended.
25. Pesticide Labels and Legal Requirements Control
All pesticide applications are subject to registered product labeling and applicable law. Honex will not knowingly apply a pesticide in a manner prohibited by its label or applicable regulatory requirements.
26. Customer Requests for Pesticide Information
Customers may request information concerning pesticides used or proposed for use during their service as provided by applicable law, including available product identification and safety information.
27. Children, Pets, Aquariums, and Sensitive Occupants
Customers must inform Honex of children, pets, birds, reptiles, fish, aquariums, exotic animals, pregnant occupants, known chemical sensitivities, medically fragile occupants, or other circumstances that may materially affect treatment.
Customers are responsible for following temporary removal, covering, ventilation, re-entry, pet, food, and other safety instructions communicated by Honex or required by product labeling.
28. Pet Safety and Property Access
Customers must safely secure pets when reasonably requested. Honex is not responsible for escaped animals or incidents caused by aggressive or unsecured animals. Personnel may decline to enter an area presenting an unreasonable animal-related safety risk.
29. Customer Preparation and Post-Treatment Duties
Certain treatments require preparation such as removing food, clearing cabinets, moving items, covering aquariums, securing pets, vacating areas, removing clutter, correcting standing water, or providing access. If required preparation is not completed, Honex may modify, postpone, or reschedule service.
Customers agree to follow reasonable post-treatment instructions regarding re-entry, cleaning, treated surfaces, bait placements, traps, monitoring devices, ventilation, moisture control, sanitation, exclusion, and follow-up.
30. Disclosure of Prior Pest-Control Products
Customers should disclose known recent professional or do-it-yourself pest-control products, including sprays, foggers, baits, dusts, repellents, rodenticides, or home remedies, because they may affect treatment strategy or effectiveness.
31. Authority to Authorize Service
By booking service, the customer represents that the customer owns the property, lawfully occupies it, or has obtained any permission reasonably required from the owner, landlord, property manager, HOA, condominium association, or other responsible party. Renters may book directly, and Honex may rely on the customer's representation of authority without independently confirming permission with a landlord, manager, or association unless Honex chooses to do so.
32. Apartments, Condominiums, and Multi-Unit Properties
Pest activity in multi-unit structures may move through shared walls, plumbing, utility penetrations, attics, crawl spaces, hallways, common areas, or neighboring units. Honex cannot guarantee control of pest sources located in areas it cannot lawfully access or treat. Building-wide or adjacent-unit treatment may be necessary.
33. Neighboring Properties and External Conditions
Pests may originate from neighboring properties, landscaping, waterways, trash areas, construction, vacant structures, commercial properties, or natural areas. Honex does not control these external sources and cannot guarantee against reinfestation originating outside the serviced property.
34. Structural Conditions and Exclusion
Pest activity may be caused or worsened by cracks, gaps, roof openings, damaged screens, plumbing penetrations, moisture, water intrusion, damaged seals, drainage issues, vegetation contact, or construction defects. Unless structural work is specifically purchased, Honex is not responsible for repairing these conditions.
35. No Building, Engineering, Medical, or Environmental Inspection
Pest service is not a structural, engineering, mold, environmental, electrical, plumbing, roofing, building-code, medical, veterinary, or real-estate inspection unless expressly stated in a separate written agreement. Any observations outside pest control are provided only as general information.
36. Pre-Existing and Pest-Caused Damage
Honex is not responsible for damage or conditions that existed before service or damage caused directly by pests merely because Honex performed pest-control services. Unless a separate written agreement expressly provides otherwise, Honex does not insure property against pest activity or pest-caused damage.
37. Concealed or Inaccessible Areas
Pests may occupy closed walls, ceilings, inaccessible attics or crawl spaces, plumbing systems, locked areas, structural voids, underground areas, furniture, stored goods, or neighboring properties. Honex cannot guarantee identification or treatment of every concealed pest source.
38. Personal Property and Reasonable Access Work
Customers should secure valuables, fragile items, confidential documents, electronics, artwork, firearms, and other sensitive property before service. Specialty work may sometimes require reasonable access measures. Material alteration should be separately authorized where appropriate.
39. Scheduling and Arrival Windows
Appointment times and arrival windows are estimates unless expressly stated otherwise. Traffic, weather, prior appointments, emergencies, technician availability, vehicle issues, access problems, or treatment complexity may affect timing. Honex will make reasonable efforts to communicate material delays.
40. Same-Day Service
References to same-day service mean same-day appointments may be available depending on booking time, location, technician availability, service type, weather, licensing, and capacity. They are not an unconditional guarantee that every customer will receive service on the same calendar day.
41. Rescheduling, Weather, and Force Majeure
Honex may reasonably reschedule or modify service because of weather, unsafe conditions, technician illness, equipment or vehicle issues, emergencies, regulatory restrictions, customer access problems, natural disasters, public emergencies, supply shortages, road closures, or other circumstances beyond reasonable control.
41A. Scheduled Service When Customer Is Not Home
If the customer is not home for a routine scheduled visit but Honex can access serviceable exterior portions of the property, the technician may perform the exterior service to the best of Honex's reasonable ability using available lawful access. That exterior treatment counts as the customer's scheduled routine service. Lack of interior access does not create an automatic refund or require a duplicate routine visit, although the customer may still request a qualifying callback for covered pest activity under the active plan.
41B. Property Completely Inaccessible at Scheduled Visit
If Honex arrives for a scheduled appointment and cannot reasonably access any serviceable portion of the property because of gates, locks, animals, access restrictions, customer absence where access is required, or another condition within the customer's control, the scheduled payment remains due. Honex will notify the customer and provide options to reschedule the missed service. The rescheduled replacement visit will not carry an additional trip or service-call charge.
41C. Transfer to a New Property
An active customer may request transfer of the recurring plan to a new residence within Honex's then-current service area. Honex will generally continue the existing recurring rate where reasonably appropriate, but may propose a different rate if the new property materially changes the size, pest pressure, access, treatment requirements, or service scope. Any increased rate will be disclosed before it becomes effective.
41D. Current Service Area
Honex initially serves Broward County, Palm Beach County, and portions of northern Miami-Dade County, subject to Honex's then-current routing, licensing, and operational availability. Honex may expand, reduce, or otherwise change its service area from time to time.
42. Customer Cancellations and No-Shows
Customers may cancel the recurring plan at any time. Honex recommends maintaining service for at least 90 days to allow the treatment program time to work effectively, but this is a recommendation and not a minimum contractual commitment. Appointment cancellations or rescheduling requests should be made at least 24 hours before the scheduled appointment. If a customer cancels the initial appointment at least 24 hours in advance and the initial service has not been performed, the initial payment will be refunded in full. If cancellation or rescheduling occurs within 24 hours, the existing payment is not automatically refunded; Honex will make reasonable efforts to reschedule the paid appointment without an additional trip charge.
There is no early-cancellation fee for the standard recurring plan unless a different service-specific agreement expressly and conspicuously states otherwise before purchase. Customers may cancel by phone, SMS/text, email, or available online cancellation method.
43. Recurring Payment Authorization
By enrolling in a recurring plan, the customer authorizes Honex and its payment processor to charge the designated payment method automatically each month at the recurring rate disclosed and accepted during enrollment, plus any later charges separately authorized by the customer.
Recurring billing continues until canceled. If a payment attempt is declined, Honex may retry the authorized payment method. After a second unsuccessful attempt, routine service, complimentary callbacks, and other plan benefits may be suspended until the account is brought current. After a third unsuccessful payment attempt, Honex may cancel the plan. No routine visit or complimentary callback is provided while the account is past due. Payment may be required before each visit.
44. Automatic Renewal and Recurring Billing Disclosure
Honex will clearly disclose the recurring nature of the plan, recurring price, billing frequency, routine service frequency, included callback benefits, and applicable cancellation method before enrollment. Honex will provide any additional automatic-renewal notices required by applicable law.
45. Changes to Recurring Pricing
The recurring monthly rate is initially the amount accepted and paid at checkout. Honex may later change recurring pricing because of changes in service requirements, property conditions, costs, service scope, or other legitimate business reasons. Before a revised recurring rate is charged, Honex will notify the customer by email in advance of the next bill at which the new rate will apply. The customer may cancel before the revised rate takes effect.
46. Payment Processing
Payments may be processed by third-party payment processors. Honex may not receive or store complete payment-card information. Payment processing may also be subject to the processor's terms and privacy practices. The service price displayed and accepted by the customer is intended to be the complete customer-facing price for that service; Honex does not add undisclosed taxes, government fees, or service charges after checkout. Any legally required amount that must be separately collected in the future will be disclosed before charge.
47. Estimates, Quotes, Promotions, and Website Pricing
Estimates are based on information available at the time and may change if concealed or materially different conditions are discovered. Promotions may have eligibility, expiration, geographic, new-customer, or other disclosed limitations. Honex may correct obvious website pricing or promotional errors before service is performed.
48. Refunds After Service
Once an authorized service has been performed, payment is non-refundable except where required by law or voluntarily approved by Honex. If a recurring payment has already processed and the customer then cancels, the processed payment is not automatically refunded; Honex will make the corresponding paid service or coverage available through the applicable paid period, and future recurring charges will stop after cancellation becomes effective. Pest persistence, reinfestation, or a recommendation for additional treatment does not by itself create a refund right.
49. Billing Errors and Chargebacks
Customers should promptly contact Honex about suspected billing errors. Honex may investigate service records, payment authorization, communications, technician notes, photographs, invoices, and other relevant evidence. Nothing limits a customer's lawful right to dispute an unauthorized or improper charge.
50. Service Documentation and Property Photographs
Honex may maintain service records including customer information, dates, pest observations, treatment areas, products, methods, technician notes, recommendations, approvals, payment status, and relevant property photographs for operational, safety, quality-control, regulatory, insurance, billing, and dispute-resolution purposes.
Honex will use reasonable efforts to avoid unnecessary photographs of people or private personal information. Service documentation photographs will not be used in advertising in an identifying manner without appropriate permission.
51. Electronic Acceptance and Records
The parties agree that transactions may be conducted electronically. Checking an acceptance box, clicking a booking or acceptance button after disclosures, electronically signing, submitting payment, or otherwise affirmatively authorizing service may constitute electronic acceptance.
Honex may retain the date, time, booking/customer identifier, recurring rate, applicable version of terms, and other evidence of electronic acceptance.
52. Transactional Communications
By providing contact information, customers authorize Honex to communicate regarding booking confirmations, appointment reminders, technician arrival, rescheduling, access, treatment instructions, service follow-up, receipts, billing, and other non-marketing matters related to the customer relationship.
53. Marketing Communications
Where separate consent is required by law for marketing text messages, automated marketing calls, or similar communications, marketing consent is not a condition of purchasing pest-control services. Customers may opt out of marketing communications using the instructions provided.
54. Commercial Services
Commercial pest-control services may require separate pricing, monitoring, logs, regulatory compliance, food-service procedures, additional access requirements, or site-specific agreements. A commercial agreement may supersede these Terms where expressly stated.
55. Service Area
Honex determines the geographic areas in which particular services are available. Availability may vary based on licensing, location, technician coverage, service type, travel distance, or operational capacity.
56. Right to Refuse or Terminate Service
Honex may refuse, suspend, or terminate service for legitimate safety, legal, regulatory, fraud, nonpayment, abusive conduct, harassment, discrimination against personnel, aggressive animals, unsafe property conditions, unlawful treatment requests, material misrepresentation, repeated interference with treatment, or other legitimate business reasons. Honex will not refuse service for an unlawful discriminatory reason.
57. Safety of Honex Personnel
Customers must provide a reasonably safe working environment. Honex personnel are not required to enter areas involving active violence, uncontrolled aggressive animals, visibly unsafe structures, dangerous electrical conditions, apparent hazardous-material risks, unsafe climbing conditions, or other unreasonable safety hazards.
58. Website Information and Pest Identification
Website information is general and does not replace an on-site assessment. Customer pest identification may be incorrect. If the technician identifies a materially different pest or condition, Honex may modify the service, recommend a different service, provide revised pricing, or decline an inappropriate treatment. Material additional charges require customer approval.
59. Website Availability, Errors, and Third-Party Services
Honex does not guarantee uninterrupted website or booking-system availability. Honex may correct typographical, pricing, technical, service-description, or availability errors. The website may use third-party payment, mapping, analytics, advertising, scheduling, CRM, email, SMS, or other technology services that are also subject to their own terms and privacy practices.
60. Intellectual Property and Acceptable Website Use
Honex names, logos, original website copy, graphics, designs, photographs, software, and other protected content are owned by Honex or used with permission. Users may not interfere with website operation, attempt unauthorized access, transmit malware, submit fraudulent bookings, misuse payment information, or unlawfully copy protected materials.
61. No Medical or Disease-Prevention Advice
Information about pests, bites, stings, pesticides, allergens, disease, or health effects is general educational information and not medical or veterinary advice. Pest-control service is not a guarantee against disease transmission, infection, allergic reaction, bites, stings, or other health outcomes.
62. Limitation of Warranties
Except for written warranties or guarantees expressly provided by Honex and except where prohibited by law, services are subject to the inherent limitations of professional pest management. Nothing in these Terms waives any non-waivable consumer right or warranty.
63. Limitation of Liability
To the fullest extent permitted by applicable law, Honex will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from pest activity, reinfestation, inability to completely eliminate pests, circumstances outside Honex's reasonable control, delayed service, or website use.
To the fullest extent permitted by law, and except for liability that cannot legally be limited, Honex's aggregate contractual liability arising directly from a particular service will not exceed the amount actually paid to Honex for the specific service giving rise to the claim.
64. Damage Claims and Mitigation
If a customer believes Honex caused property damage, the customer should promptly notify Honex, take reasonable steps to prevent avoidable additional damage, preserve relevant evidence, and provide reasonable inspection access. Honex may request photographs, receipts, repair estimates, proof of ownership, and other documentation. Investigation does not constitute an admission of liability.
65. Insurance and Regulatory Compliance
Honex maintains insurance and licensing as required by applicable law for the services it performs. Nothing in these Terms authorizes unlicensed activity, work outside an authorized category, pesticide misuse, unlawful fumigation, unlawful WDO treatment, or any other prohibited activity. Mandatory legal requirements control over conflicting contractual language.
66. Informal Complaint and Dispute Resolution
Honex encourages customers to promptly contact us regarding service or billing concerns and to provide a reasonable opportunity for investigation and resolution. Before filing a lawsuit, the parties are encouraged, where practical, to exchange written notice describing the customer, property, service, dispute, and requested resolution. This does not prevent urgent legal relief or the exercise of non-waivable legal rights.
67. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, except where federal law or another non-waivable law controls. To the extent permitted by law, court proceedings arising from these Terms or Honex services shall be brought in a court of competent jurisdiction in the Florida county where Honex maintains its principal business operations, unless applicable law requires otherwise.
68. Severability, No Waiver, and Assignment
If any provision is invalid or unenforceable, it will be enforced to the maximum extent legally permissible and the remaining provisions will continue in effect. Failure to enforce a provision on one occasion does not waive later enforcement.
Customers may not transfer a service agreement or guarantee to another property or person unless permitted by the applicable agreement or approved by Honex. Honex may assign rights or obligations in connection with a lawful business sale, merger, reorganization, or transfer, subject to applicable law.
69. Changes to These Terms
Honex may update these Terms as its services, technology, or applicable law changes. The current version will be posted with a revised Last Updated date. For an already completed transaction or booked service, the Terms accepted in connection with that transaction generally govern unless the parties later agree otherwise or law requires a change.
70. Entire Agreement
These Terms, together with applicable booking disclosures, proposals, service agreements, work orders, invoices, treatment authorizations, guarantees, recurring-service terms, termite/WDO agreements, Privacy Policy, and other expressly incorporated written terms constitute the agreement applicable to the relevant service. Oral statements do not modify an express written term unless confirmed by an authorized Honex representative in writing.
71. Privacy
Honex's collection, use, retention, and disclosure of personal information is governed by its Privacy Policy, which is incorporated into these Terms by reference.

73. Customer Acknowledgment
By booking or authorizing Honex services, the customer acknowledges that the price accepted at checkout is the initial service price and ordinarily the recurring monthly rate; recurring billing generally begins 30 days after purchase and continues until canceled; routine preventative treatment generally occurs every 80 to 100 days; qualifying covered callbacks are included at no additional service charge subject to a one-callback-per-seven-day limit while the account is active and current; the standard plan covers only the pests and service scopes described in these Terms; severe or specialty conditions may require separately priced service with customer approval; and pest-control results depend on conditions that may be outside Honex's reasonable control.

Unless otherwise stated at checkout, your plan is cancel-anytime and includes monthly recurring billing beginning approximately 30 days after your initial purchase, routine preventative treatment approximately every 80 to 100 days, and qualifying callback treatments for covered pests at no additional service charge, limited to one callback visit within any seven-day period while your account is active and current. Severe infestations and specialty services may require separate pricing and your approval.
